Introduction
Welcome to my Terms and Conditions for my art commissions! I am so happy that you have decided to take interest in my services to bring your artistic vision to life!
But before anything happens, I want us (both buyer and seller) to be on the same page regarding the conditions of my art commissions, and that you (the client) understand the terms and conditions I have set.
As a digital artist taking in commissions, I take pride in giving the best experience for my clients, and that I am here to bring your vision to life.
To make certain that our collaboration will take place without any delays, I have set some terms and conditions that the client must understand and abide by.
These are set to protect our respective interests, and so that we both have a clear understanding of what to expect throughout the commission process.
So I advise you, the client, to review the entirety of my Terms and Conditions before we begin anything.
And if you have any questions and/or concerns regarding this document, don’t hesitate to ask me.
Customer Satisfaction
- I will do everything in my power to ensure that my clients are satisfied with their commission(s).
- If you, the client, have any problem with the commissioned artwork—tell me immediately, so that we can find a possible solution together.
- Your satisfaction is the central goal of this commission, so communication is crucial in the commissioning process. If you have encountered any problem with my way of communication, let me know so that i may adapt to the situation at hand.
General Guidelines
- By commissioning me, you have agreed to these terms and conditions I have set, and fully understand this document.
- I do not authorise using any of my artworks as NFTs.
- I do not authorise any of my artworks to be fed in any AI generator or used in an AI generator in any sort of way.
- I work best by being given multiple references and sources from the client regarding their expected commissioned piece. Although expect some different variations of it.
- I may use 3D models and/or photobashing on my commissions during the sketch process to help conceptualise the idea of the commission.
Customer Use
- The buyer has reserved the rights to:
- Claiming rights to the character (in the case of original character commissions), but not the artwork itself.
- Sharing/reposting the artwork as they see fit, with proper credit.
- The following is considered copyright infringement:
- Claiming the creation of the artwork itself.
- Removing the artist’s watermark/signature from the artwork.
- Changing the artwork without the consent and/or knowledge of the artist.
Payment
- At the moment, I only accept payments through Gcash, Paypal, and credit/debit card
- In the case of Paypal, I will be sending the clients invoices and only accept United States Dollar (USD), and Philippine Peso (PHP).
- In the case of credit/debit card, the client will be sent an invoice from Artistree (may include some fees for the client). That is how the client will be paying the artist.
- Payments can be either:
- 50% before I start your commission (or right after I send over the sketch), and 50% before I send the finished piece.
- OR 50% before I start your commission (right after I send over the sketch), and 50% while I’m finishing the piece.
- OR 100% before I start your commission.
- I will only continue working on your commission once I have been paid in full or the first-rate of the agreed payment.
Refund and Cancellation
- No refunds once the piece is already finished.
- If the client wants to cancel—depending on how much work was done, the client must still pay for the work that was done.
- The buyer will receive a full refund if for any reason I am not able to complete the commission.
- Artist will cancel slot for client:
- Paypal: After 3 days of unpaid invoice, your commission will be cancelled.
- Gcash: After 3 days of the client not sending full or first-rate payment, your commission will be cancelled.
Delivery Time
- Commissions can take from 2 days up to 1.5 weeks depending on the complexity of the piece. It may exceed the estimated time of delivery if delays occur. These delays include but are not limited to school, health, and family issues. If any delays arise, you will be notified.
- The artist will have an active communication all throughout the process and will update the client on everything regarding their commission.
